How to Start a Foreclosure at Old Republic Trustee Services
Commencing a statutory foreclosure in California requires a few simple steps to
get the process started. First and foremost you must complete, sign and return
our online Declaration of Default and Request to Prepare Notice of Default.

Step 1: Download the
Declaration of Default (open the document/click on Save A
Copy in the toolbar). Once saved, fill out the Declaration of Default
then immediately print it out. Adobe Acrobat will not allow you to
save the filled out version of this document so take special care to print
it out as soon as you are done filling it out.
Once you have filled out the Declaration of Default (hint: the easiest way to
fill out the Declaration of Default is by typing the data requested in the
various fields) you must sign and date the Declaration.
Step 2: Print out the Declaration of Default then SIGN and DATE the document.
Once you have signed and dated the original Declaration of Default you should
gather the documents required by the Trustee to process your foreclosure.
These documents include a copy of the original promissory note, a copy of the
deed of trust, a copy of any assignments of the Deed of Trust, a copy of any
modifications to the Note or Deed of Trust, a copy of any loan servicing
agreements entered into in connection with the underlying Note and Deed of Trust.
Step 3: Copy the following documents:
- -Promissory Note(s)
- -Deed(s) of Trust
- -Modification Agreements, if any
- -Loan Servicing Agreements, if any
With your Declaration of Default completed, signed and dated and your loan
documents copied, you are ready to fax or email the documents to Old
Republic Trustee Services. Your fax or email should be addressed to
